PENA DE MORTE NÃO É SOLUÇÃO!

Mais do que desfeito está o mito de que a pena de morte dissuade o crime violento. Ora leiam lá isto... "...A pena de morte não é mais eficiente em dissuadir a prática de crimes violentos do que as longas penas. Na verdade, nos Estados Unidos, os estados que adotam a pena de morte têm quase o dobro das taxas de homicídios daqueles que não a adotam. No Brasil, o grande número de execuções extralegais de criminosos e suspeitos não tem tido nenhum efeito sobre a criminalidade. Nada indica que a instauração da pena de morte possa diminuir aqui a taxa de criminalidade. Mesmo que os dados estatísticos quanto à relação entre pena de morte e criminalidade sejam limitados, está comprovado o fato de que a presença da pena de morte tem um efeito de brutalização nas relações sociais, contribuindo para que crimes violentos como o homicídio sejam estimulados ao invés de evitados. Essa brutalização reforçaria a desumanização que já caracteriza as relações da sociedade brasileira com os criminosos e suspeitos, vistos como bestas selvagens a serem abatidas, ao arrepio de qualquer provimento legal. A pena de morte não viria substituir mas subsidiar essas práticas. Numa sociedade tão desigual como a brasileira, em termos de renda e de raça, onde a população negra e pobre é percebida como parte das “classes perigosas” capazes de cometer crimes, os negros e os pobres, além das dramáticas limitações do judiciário na maioria do país (especialmente naqueles estados do Norte e Nordeste onde o arbítrio é maior), os discriminados terão maior probabilidade de serem executados, inocentes ou culpados...": http://www.dhnet.org.br/direitos/penamorte/paulopinheiro.htm Erros pagos com a vida... Uma defesa precariamente preparada, a falta de provas, ou mesmo a decisão de falsa acusação por parte das autoridades responsáveis, podem resultar em condenações erradas. Essas condenações são dificilmente reversíveis, já que os tribunais de recurso dificilmente consideram novas provas. Muitos prisioneiros têm sido executados ao longo das últimas décadas, apesar das fortes dúvidas acerca da sua real culpa. Outros têm sido libertados após a re-examinação dos seus casos, sendo provado que foram condenados injustamente. É impossível determinar quantas pessoas inocentes foram condenadas à morte. "...Doenças Mentais: É globalmente aceite que, pessoas com problemas mentais, não devem ser responsabilizadas pelos seus actos e, mais ainda, alguns criminosos não devem ser julgados com base nas leis normais do Sistema Criminal de Justiça. Um principio importante é o que defende que um prisioneiro condenado à morte, mas que é doente mental, não deve ser executado, pois ele é incapaz de compreender a natureza da punição. Estes princípios estão enunciados na Resolução 2005/59, adoptada a 20 de Abril de 2005. Vários prisioneiros durante as últimas décadas, foram executados em casos em que os recursos de defesa foram deficientes ou mesmo inexistentes. Outros casos continuam a ser ouvidos em tribunais especiais, em segredo de justiça, sem que haja uma adequada representação da defesa ou por juizes que nem sempre são competentes ou independentes. Outros dados arrepiantes, que eu preferia não ter que acrescentar...

• No Japão, um condenado treme de cada vez que ouve as botas do guarda prisional avançar no corredor da morte pois não sabe se será a sua vez de ser executado, dado que não sabe em que dia ou hora ou que tempo ainda lhe resta para esperança e lutar por justiça para si. Conseguem imaginar o que é estar na pele dele?


• Em países radicais muçulmanos uma mulher quase só pode olhar em frente ou para baixo, para o chão se tiver um homem à sua frente pois o machismo por lá é letal...por vinganças mesquinhas , certos vizinhos ou familiares apresentam queixa de alguma mulher por adultério para que esta seja apedrejada e é fácil sê-lo mesmo inocente.


• conseguem imaginar a dor da mãe de um condenado, sobretudo se ainda for menor como em certos países, no dia e hora em que sabe que lhe estão a matar o filho?! qual foi o crime dela? amar?!

Sabias que há familiares de vitimas de crime violento que SÃO CONTRA A APLICAÇÃO DA PENA DE MORTE?

"...Será que as execuções são uma forma de fazer justiça perante as vítimas de crime violento e das suas famílias? Muitos dos que defendem a aplicação da pena de morte fazem-no em nome dos “direitos das vítimas”. Argumentam que as vítimas de crime violento e os seus entes queridos têm o direito a ver a vida do perpetrador ser tirada pelo estado. No entanto, mesmo que seja compreensível que as vítimas de crime violento e as suas famílias sintam raiva em relação aos perpetradores de tais actos, esse argumento não pode ser usado para justificar a violação dos direitos humanos dos condenados por esses crimes. A finalidade e crueldade inerentes à pena de morte tornam-na incompatível com as normas do comportamento civilizado da sociedade actual. É uma forma desadequada e inaceitável de dar resposta ao crime violento. O apoio à pena de morte sustentado na consideração para com as vítimas tem implícita a ideia de que todos os afectados pelo crime violento apoiam a pena de morte universalmente, o que está longe de ser verdade. Muitos familiares de vítimas de homicídio objectam contra a aplicação da pena de morte em nome dos seus entes queridos. Nos EUA, o grupo Famílias de Vítimas Assassinadas em luta pelos Direitos Humanos tornou-se numa voz poderosa contra as execuções: “Acreditamos que os familiares das vítimas de homicídio têm algo a dizer no debate acerca de como devem as sociedades punir o homicídio e têm a autoridade moral para exigirem uma ética consistente com o respeito pelos direitos humanos como parte dessa resposta. O grupo Famílias de Vítimas Assassinadas em luta pelos Direitos Humanos constitui-se como uma resposta a essa necessidade.” Marie Deans, cuja sogra foi assassinada em 1972, afirma: “Após um homicídio, as famílias das vítimas enfrentam duas situações: uma morte e um crime. Nessa altura, as famílias precisam de ajuda para lidar com a sua perda, e apoio para curar a ferida nos seus corações e reconstruir as suas vidas. Sabemos por experiência que a vingança não é a resposta. A resposta consiste em reduzir a violência, não em causar mais mortes. A resposta reside em apoiar os que sofrem devido à perda dos seus entes queridos, não em criar mais famílias em sofrimento [através da execução de um familiar]. Está na altura de quebrar o ciclo de violência.” As mesmas pessoas que justificam a aplicação da pena de morte através dos direitos das vítimas raramente falam acerca do sofrimento que as execuções causam aos demais. O trauma para os guardas prisionais envolvidos nas execuções, o sofrimento emocional da família e dos entes queridos do executado, os advogados de defesa que de alguma forma podem sentir que falharam em relação ao cliente executado e várias outras pessoas traumatizadas pelas execuções são simplesmente ignorados pelos líderes políticos que enumeram as vantagens das execuções ao eleitorado. “As pessoas não compreendem que a pena de morte tem um impacto realmente abrangente nas famílias” diz Jonnie Wanner. O seu irmão, Larry Griffin, foi executado no estado de Missouri, EUA, em 1995. “A minha mãe nunca conseguiu superar [a execução do filho]. Ela mudou tanto desde que isso aconteceu. Todos os miúdos têm muita dificuldade em compreender. Já ouviste falar sobre um homem chamado Tookie williams? foi a mais comovedora e elevada redenção humana e cristã que já vi nos últimos tempos. No entanto, mesmo com um país a defender a clemência para Tookie, o governador da Florida: Arnold Shwarzeneeger, resolveu fazer o papel de Deus e julgar onde Ele não o faria...o abuso de poder contra a vontade do povo... Gênero: Drama Ano de Lançamento: 2004 Sinopse: O filme mostra a mudança de comportamento de Stan Tokkie Williams, que depois de criar a principal gangue de Los Angeles, os Crips, é condenado a pena de morte e passa a escrever uma série de livros infantis denunciando a ação e os perigos das gangues. Your Excellency: This is the sad list of countries that still apply death penalty , some even to children and adolescents, to mentally ill people, to innocents (recognized as such too late) , still apply it to human beings whose life should be respected by authorities in each country simply because if they killed, even if they are killers the state or country should not be or we live in a land of anarchy and no values. Some are killed while suffering a great deal (like in stoning), and none of this is decent, honorable or even human. I hate to know that while I have dinner some have their last meal. And all because none of those who make the decision to put a man in death row ever thinks of how he or her would feel in the convict skin… even if he or her are cold blood killers , what is there to say about a judge, a politician, a state that does the same without any empathy just like the convict, like the killer? Can you picture yourself or loved ones there, in his or her place? Being healthy and maybe even changed , or chemicaly unable to ever change: yet you are to die in the morning without anyone around you do anything to stop that CRIME?! It is a crime and a sin: make no mistake about it… Will this useless horror ever stop?! It is really useless. 1 - the death penalty violates the right to life. The Universal Declaration of Human Rights (UDHR) recognises each person’s right to life. Article 4 of the African Charter on Human and Peoples´ Rights (ACHPR) states that "human beings are inviolable. Every human being shall be entitled to respect for his life and the physical and moral integrity of his person." This view is reinforced by the existence of international and regional treaties providing for the abolition of the death penalty, notably the second optional protocol of the International Covenant on Civil and Political Rights, adopted by the General Assembly of the United Nations in 1989. 2 - the death penalty is a cruel and inhuman death. The UDHR categorically states that "No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment." All forms of execution are inhuman. No government can guarantee a dignified and painless death to condemned prisoners, who also suffer psychological pain in the period between their sentence and execution. 3 - the death penalty has no dissuasive effect. No scientific study has proved that the death penalty has a more dissuasive effect on crime than other punishments. The most recent investigation into the links of cause and effect between capital punishment and the murder rate, was conducted by the United Nations in 1988 and updated in 2002. It came to the following conclusion: "...it is not prudent to accept the hypothesis that capital punishment deters murder to a marginally greater extent than does the threat and application of the supposedly lesser punishment of life imprisonment." 4 - the death penalty is premeditated murder, demeans the state and makes society more violent. By executing a person, the state commits a murder and shows the same readiness to use physical violence against its victim as the criminal. Moreover, studies have shown that the murder rate increases immediately after executions. Researchers have suggested that this increase is similar to that caused by other violent public events, such as massacres and assassinations. 5 - the death penalty is discriminatory in its application. Throughout the world, the death penalty is disproportionately used against disadvantaged people. Some condemned prisoners from the most impoverished social classes would not have been sentenced to death if they were from wealthier sectors of society. In these cases, either the accused are less able to find their way through the maze of the judicial system (because of a lack of knowledge, confidence or financial means), or the system reflects the generally negative attitude of society and the powerful towards them. It has also been proved that certain criminals run a greater risk of being condemned to death if their victims come from higher social classes. 6 - the death penalty denies the capacity of people to mend their ways and become a better person. Defenders of the death penalty consider that anyone sentenced to death is unable to mend their ways and could re-offend at any time if they are released. However, there are many examples of offenders who have been reintegrated and who have not re-offended. Amnesty International believes that the way to prevent re-offending is to review procedures for conditional release and the psychological monitoring of prisoners during detention, and under no circumstances to increase the number of executions. In addition, the death penalty removes any possibility for the condemned person to repent. 7 - the death penalty cannot provide social stability nor bring peace to the victims. An execution cannot give the victim his or her life back nor ease the suffering felt by their family. Far from reducing the pain, the length of the trial and the appeal procedure often prolong the family’s suffering. 8 - the death penalty denies the fallibility of human institutions. The risk of executing innocent people remains indissolubly linked to the use of the death penalty. Since 1973, 116 people condemned to death in the United States have been released after proof of their innocence has been established. Some of them have only just escaped execution, after having passed years on death row. These repeated judicial errors have been especially due to irregularities committed by prosecution or police officers, recourse to doubtful evidence, material information or confessions, or the incompetence of defence lawyers. Other prisoners have been sent to their deaths when serious doubts existed about their guilt. 9 - the death penalty is a collective punishment. This punishment affects all the family, friends and those sympathising with the condemned person. The close relatives of an executed prisoner, who generally do not have anything to do with the crime, could feel, as a result of the death penalty, the same dreadful sense of loss as the victim’s parents felt at the death of their loved one. 10 - the death penalty goes against the religious and humanist values that are common to all humanity. Human rights are universal, indivisible and interdependent. 11. The convicted has family: A mother,who commited no crime and suffers even more than the convicted man, what is her crime? loving her son or daughter? is she less of a mother than the victim's mother? sometimes baby sons and daughters, or worse; in an age where they realize what is going on...old grandmothers who die of grief, is that fair? 12. Scientists are studying the brain of violent criminals and finding out that their brain chemistry is different, and therefore they are unable to feel regret, even facing death...so where is the punishment if he or she never regrets? isn't that the goal of death penalty? 13. Many countries condemn children to death too. boys with 14 years of age or less...children are sacred anywhere, it is scaring and inhuman enough for an adult, a child has a whole life ahead to realize his or her mistake... 14. Death penalty is expensive to the public exchequer and money spent there should not be used to killing people, but to heal them, to help those sick: whether the convicted or other citizens by public health measures. 15. A crime should not be punished with another. The State has to give the good example. 16. In the cost / benefits balance the «against» arguments certainly are heavier! Since it is expensive and does not achieve any of it's goals: punishment/regret or crime dissuason, besides the fact that it punishes those around the convicted sine no man is an island, and if it is, there should be understandind to him or her, simpatizing with one who has suffered much allready... 17. Many of these men and women are judged for 5 minutes, 30 minutes of their lives where they made a mistake, their personal history is ignored and not seen with solomonic wisdom as law should do. 18. It may in fact encourage crime because you can only apply death penalty once, and so killing on, two, or ten: the price is the same, so if the murder get's caught for one he gets caught for all. 19. It also encourages crime because the executed's familie, namely sons and daughters, may increase their hate towards the State, the victims family, and may wanna do justice their way... The universal declaration of human rights was signed after World War II, this letter, as indicated, referred to all humans and I would ask your excellency whether it is for us mere mortals, we too are only human, to decide life or death to someone and take the life of another person? How many more innocents have to die via the death penalty, because of justice mistakes? how many more sick people, according to doctors and scientists, will have to die as if they were just criminals and monsters? How much more panic and terror must exist elsewhere in the world while we have breakfast? How many more mothers whose only crime they committed was to have a child, will have to suffer, innocent as they are, the tremendous pain of losing their son or daughter on the electric chair or letal injection or whatever horror may be? and innocent children lose their father for the death penalty, broken families and hurt by the State, by the government that does not give the good example? a state that does pay a crime with another crime? Until when the law of an eye for an eye? When will there be mercy and forgiveness for all human beings? The only righteous judge is God! any effort made to restore justice in a murder case will not repair the loss (and in many cases without a single mistake alike in the past, and yet enough for such hard penalty to bare? Can you imagine yourself in their place? do that exercise... Before becoming a medical student of medicine does the Hippocratic oath to save lives. However, the presence of a doctor to confirm the death of a person sentenced to death in the place of execution, or the use of organs for transplant from the convicted, blurs the line between honesty and professional integrity and hypocrisy. The transplantation of organs at the expense of the condemned makes the death penalty in China a dirty business of millions and trigger major abuses and injustices. The same happens in other countries. Medicine is not just the body but the mind, any psychologist or psychiatrist, even mediocre, knows what announced death, agreed by a state / country, means waiting for a human being who never ceased to be so: there are also the professional and institutional hypocrisy on the part of highest international agencies that should do everything in their power or influence to abolish the death penalty. The presence of a priest is also condoned with such atrocities: washing hands like Pontius Pilate instead of saying something against something so awful and inhuman as the death penalty. I apologize to the Holy see but my opinion is: killing a man , even one who killed is it still not a sin? Life and death is in the hands of god only! So the truth on this should be said with courage. Jesus dyed on the Cross and was innocent , but it has happened (the execution of innocent) with men and women by mistake…a little too late… A country that kills to avenge a death has no moral authority to impose order, to pay a murderous killing: by turning into a killer when not even the family , in their anger became…some victims family’s even reject the death penalty as punishment and say it in the media: but even so the state kills for them…strange…The death penalty teaches that revenge is something positive, the death penalty, as several studies show, does not low levels of violent crime, not guilt or regret instills in those who do not feel it…the inconvenience it represents to the majority of people in the world where degree of civilization advance already abolished death penalty who see it as something barbaric, and in countries with it too… It does not prevent the crime that is steadily increasing, including the violent crimes, ethnic cleansing that is hidden behind some executions, fails because it increases hate between races and therefore crime and violence… Who is served by the death penalty? it is time to be abolished! there are countries where even children are executed and minor crimes are punished without a fair trial as well. THE ABOLITION OF THE DEATH PENALTY is the hallmark of civilized countries. Can’t we all be civilized? STOP DEATH PENALTY! And if you do: may God bless you for it.
